UniversalizationofhumanrightsistheresultofreviewingWorldWarIIandtheproofoftheadvancementofhumancivilization.Nevertheless,practiceandprotectionofhumanrightshavealwayschallengedstateauthorityunderthecontextofsovereignty.Theexpansionoftheinternationalhumanrightslawhasreflectedagrowingneedtoreexaminestateauthorityintermsofsovereigntylegitimacy,andtoplacefurtherconsiderationonthelegitimacyofmultilateralefforts.Thispaperarguesthat(1)auniqueattributeoftherighttopeaceisthatthesubjecttofulfillingtherightisaninpidualaswellasastate.Italsodrivesadilemma:whilesustainingtherightisthedutyofastate,thestate’sassistingitscitizenstothepracticeoftherighttopeacemightbeconflictingtothefulfillmentofstateauthority;(2)itresultsfromtheviewthatthestateisregardedastheonlysubjecttopracticetheright.Assuch,thestatemightbemorelikelytoincludeinpidualstopracticetherightfromahighervision,anddealwithpossibledisputesbetweenthepersonalrighttopeaceandthecommoninterestinsocietythroughtheruleoflaw.Thefindingsfurthersuggestthat(3)amaindeterminantofeffectinpracticeoftherighttopeaceconcernshowmultilateralandstateactorsaddressingthelegitimateproblemdeterminesthepracticeofhumanrightsnormsandthecompatibilitybetweeninternationalnormsandstateauthority.(4)TheevolutionfrommilitaryconflictstopeacefuldevelopmentacrosstheTaiwanStraitisaconcretepracticeoftherighttopeace.
